Robert G. McCurry
Experienced Legal Counsel for Families, Estates and Businesses in Northwest Georgia
Robert G. McCurry is a Dalton, Georgia attorney with more than 35 years of experience representing individuals, families, business owners, closely held companies, and other clients in serious legal disputes. His practice focuses on divorce and family law, child custody, probate and estate litigation, will contests, contested probate proceedings, guardianships, business disputes, partnership disputes, corporate governance, and general civil litigation throughout Northwest Georgia.
Clients often contact Robert when a dispute is legally complex, emotionally difficult, financially significant, or likely to require decisive courtroom action. He has prepared and tried more than 150 jury trials and has represented clients in Georgia superior courts, probate courts, other state courts, federal court, and appellate proceedings. That depth of litigation experience helps him identify the controlling issues, evaluate risk realistically, develop an evidence-based strategy, and prepare each matter for negotiation, mediation, hearing, or trial.
Robert works directly with his clients. He explains the law, the available options, the likely costs, and the practical consequences of important decisions. His approach combines careful preparation, candid advice, responsiveness, and determined advocacy. When a sound resolution can be achieved through negotiation or mediation, he works to resolve the dispute efficiently. When litigation is necessary, he is prepared to present the case clearly and forcefully.
Divorce, Family Law and Child Custody
Robert represents clients in divorce and domestic-relations matters involving child custody, parenting time, child support, alimony, property division, business interests, retirement assets, enforcement, modification, and contempt. Family-law disputes often involve both immediate personal concerns and long-term financial consequences. Robert helps clients understand the legal standards, preserve important evidence, and make informed decisions during a difficult transition.

His experience is particularly valuable in contested divorce and child-custody cases involving complex finances, closely held businesses, disputed income, significant property, parental fitness allegations, relocation issues, or repeated post-judgment conflict.
Probate, Will Contests, Contested Estates and Guardianships
Robert represents executors, administrators, heirs, beneficiaries, family members, and other interested parties in probate and estate disputes. His probate litigation practice includes will contests, caveats, claims of undue influence or lack of testamentary capacity, fiduciary disputes, executor and administrator disputes, estate-accounting issues, contested distributions, and related civil claims.

He also handles contested guardianship and conservatorship matters involving the care, decision-making, property, or financial affairs of an adult who may lack capacity. These proceedings require close attention to statutory procedure, medical and financial evidence, family dynamics, and the rights of the proposed ward.
Business Disputes, Partnership Disputes and Corporate Governance
Robert represents business owners, shareholders, members, partners, companies, and individuals in business and commercial disputes. Matters may involve breach of contract, unpaid accounts, ownership and control, partnership or member disputes, fiduciary duties, shareholder rights, corporate governance, business breakups, fraud, restrictive covenants, real-property issues, and other commercial claims.

Because many business disputes combine legal, accounting, operational, and personal issues, Robert focuses on the practical business objective as well as the legal claim. He works with clients to evaluate litigation risk, protect company assets, preserve records, address governance failures, and pursue a resolution that reflects the client’s economic priorities.

General Civil Litigation and Trial Practice
Robert handles selected general civil litigation involving contracts, property, financial obligations, equitable claims, injunctions, declaratory relief, and other disputes requiring experienced trial counsel. His broad civil-litigation background is especially useful when a matter crosses traditional practice-area boundaries—for example, when a divorce involves business ownership, a probate dispute involves real estate or corporate interests, or a partnership conflict includes fraud and fiduciary-duty claims.

Each case begins with a disciplined assessment of the facts, documents, witnesses, governing law, available remedies, likely expense, and realistic outcomes. Robert prepares matters with trial in mind while remaining focused on the most effective path to resolution.
